T

he Berta Cáceres homicide trial was suspended Monday September 17 pending the review of six appeals challenging the constitutionality of the proceedings and the judges’ impartiality. The defense attorneys presented four of the appeals and Berta’s family’s private prosecutors presented two, including the challenge against the presiding judges.

The petitions are awaiting review by the Chamber of Constitutionality of the Supreme Court and the Court of Appeals. The respective courts will decide if the trial will continue as is or if the attorneys’ concerns will be addressed.

Timing on the decision is crucial. We hope the trial will end by November 3 when the pretrial detention of the suspects reaches the legal limit.
